Two men could face multiple felony charges for allegedly trying to enter others’ vehicles after trying the back hatch on a car that was occupied, according to court records.
Evans police responded about 3:30 a.m. Aug. 18 to a report of suspicious activity in the area of 31st and Denver streets. There, a man told police he was sitting in his Toyota Sienna when he heard someone try opening the back hatch of his car.
The man inside the Toyota looked out to see a man in a red jacket and another in a stocking hat. He watched as they tried opening the doors on two other cars parked in the 3000 block of Denver Street, according to court records. The vehicles were locked, and nothing appeared to have been taken.
Police contacted the suspects, identified as 29-year-old Joe Dalton Mefford and 30-year-old Willie Mack McCrary and arrested them on suspicion of three counts of attempted first-degree criminal trespass. Mefford told police the two were dumpster diving and denied trying to enter any vehicles, according to an affidavit for his arrest.
As police searched Mefford, they found a small baggie containing a tenth of a gram of presumptive positive meth, the affidavit states. He said he found the substance while dumpster diving, as well as a pipe, according to the affidavit.
McCrary remains in custody at the Weld County Jail as of Sunday, and Mefford has since been released.
The Weld District Attorney’s Office has a deadline of 3:30 p.m. Friday to file formal charges against Mefford and a deadline of 3:30 p.m. Sept. 22 to file formal charges in the case against McCrary.
